{"id":51463,"date":"2026-07-28T08:11:06","date_gmt":"2026-07-28T08:11:06","guid":{"rendered":"https:\/\/naijaglobalnews.org\/?p=51463"},"modified":"2026-07-28T08:11:06","modified_gmt":"2026-07-28T08:11:06","slug":"johnson-johnson-to-pay-5-5bn-settlement-in-talc-cancer-lawsuit-johnson-johnson","status":"publish","type":"post","link":"https:\/\/naijaglobalnews.org\/?p=51463","title":{"rendered":"Johnson &#038; Johnson to pay $5.5bn settlement in talc cancer lawsuit | Johnson &#038; Johnson"},"content":{"rendered":"<p>\n<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson said it would pay an estimated $5.5bn to resolve tens of thousands of lawsuits alleging its baby \u2060powder and other talc products caused \u2060ovarian cancer, in a landmark \u200bdeal that could end a contentious, decade-long legal battle.<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson on Monday said the settlement covers about 76,000 claims, including ones consolidated in a federal court in New Jersey, and related cases in state court, \u2060representing nearly all of the remaining talc claims against the company.<\/p>\n<p class=\"dcr-1s160rg\">The US multinational had previously settled most of the cases alleging that its talc contained asbestos and caused mesothelioma.<\/p>\n<p class=\"dcr-1s160rg\">Plaintiffs\u2019 law firms confirmed the deal on Monday, saying it was a good resolution after a \u206010-year court battle. The deal must be accepted by 95% of the ovarian cancer claimants in state or federal court before it becomes final.<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson\u2019s vice-president \u200bof litigation, Erik Haas, said the claims were \u201cmeritless\u201d and that the company \u200cwas willing to settle in order to get \u200cclosure.<\/p>\n<p class=\"dcr-1s160rg\">\u201cWhile we are confident the company would have ultimately prevailed with further litigation, as it has in the vast majority of cases tried to date, \u200cthis resolution allows the company to put this matter behind it and remain focused on its mission to develop medicines and devices that save lives,\u201d Haas said.<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson expects to pay $3bn in 2027, and it will make further payments in 2028. But the deal could be worth more, depending on how many people participate in the settlement.<\/p>\n<p class=\"dcr-1s160rg\">Chris Seeger, a lawyer who represents about 2,500 clients with talc claims and helped negotiate the agreement, said Johnson &amp; Johnson could ultimately pay $7bn or more.<\/p>\n<p class=\"dcr-1s160rg\">The settlement assigns specific values to qualifying ovarian cancer claims but does not cap Johnson &amp; Johnson\u2019s total payout, Seeger said. \u201cWe got \u200ca fair settlement, and our clients are going to be happy with it.\u201d<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson reached the settlement after a series of wins in court, including victories in individual trials, successful efforts to disqualify \u200bplaintiffs\u2019 lawyers from the litigation, and court rulings against experts that plaintiffs had used to prove their cases in court.<\/p>\n<p class=\"dcr-1s160rg\">The company, headquartered in New Jersey, won a significant court victory in the long-running legal battle last week, when a federal judge cast doubt on individual plaintiffs\u2019 ability to prove that talc specifically caused their ovarian cancer.<\/p>\n<p class=\"dcr-1s160rg\">Johnson &amp; Johnson has long denied that its talc products caused cancer, saying that talc was safe and did not contain asbestos.<\/p>\n<p class=\"dcr-1s160rg\">The company stopped selling talc-based baby powder in the US in 2020, switching to \u2060a cornstarch product. But litigation resumed in March 2025, after being put on hold for more than three years while Johnson &amp; Johnson unsuccessfully pursued a strategy known as the \u201cTexas two step\u201d, \u200bfiling three bankruptcies through a shell-company subsidiary in an \u200beffort to settle the cases. Each bankruptcy ended in dismissal.<\/p>\n<p class=\"dcr-1s160rg\">Before the bankruptcy attempts, Johnson &amp; Johnson had a mixed record in talc trials, \u200bwith a multibillion dollar verdict in \u200cfavour of 22 women who said \u200bbaby powder caused their ovarian \u200bcancer.
