{"id":48877,"date":"2026-04-29T11:01:35","date_gmt":"2026-04-29T11:01:35","guid":{"rendered":"https:\/\/naijaglobalnews.org\/?p=48877"},"modified":"2026-04-29T11:01:35","modified_gmt":"2026-04-29T11:01:35","slug":"sussex-university-overturns-585000-fine-as-high-court-rejects-free-speech-breach-claim-university-of-sussex","status":"publish","type":"post","link":"https:\/\/naijaglobalnews.org\/?p=48877","title":{"rendered":"Sussex University overturns \u00a3585,000 fine as high court rejects free speech breach claim | University of Sussex"},"content":{"rendered":"<p>\n<\/p>\n<p class=\"dcr-130mj7b\">Sussex University has overturned a \u00a3585,000 fine by England\u2019s higher education watchdog after the high court rejected claims the university had breached free speech regulations involving its former professor Kathleen Stock.<\/p>\n<p class=\"dcr-130mj7b\">The ruling is a damaging blow to the credibility and management of the Office for Students, after the court rejected the regulator\u2019s lengthy investigation into Sussex\u2019s handling of the protests aimed at Stock over her views on transgender rights and her subsequent resignation in 2021.<\/p>\n<p class=\"dcr-130mj7b\">The \u00a3585,000 fine announced by the OfS in March last year was the largest ever levied by the regulator, but Wednesday\u2019s high court ruling will send it and the Department for Education back to the drawing board to establish its legal authority.<\/p>\n<p class=\"dcr-130mj7b\">The result also calls into question the role played by Arif Ahmed, the former Cambridge University philosopher who led the investigation into Sussex. Ahmed was appointed by the previous government as the OfS\u2019s first \u201cfree speech tsar\u201d \u2013 formally known as director for freedom of speech and academic freedom \u2013 in 2023.<\/p>\n<p class=\"dcr-130mj7b\">The OfS\u2019s three-and-half-year-long investigation claimed that Sussex\u2019s \u201cgoverning documents\u201d included policy statements on transgender issues that were liable to stifle or restrict free speech. But Sussex\u2019s vice-chancellor, Sasha Roseneil, said the OfS had incorrectly included irrelevant or peripheral documents and lacked legal authority to do so, describing the fine as \u201cwholly disproportionate\u201d.<\/p>\n<p class=\"dcr-130mj7b\">At the high court hearings in March, Sussex\u2019s lawyers said the OfS decision was \u201cprocedurally unfair\u201d and its approach was \u201cin certain respects unreasonable\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The OfS had argued that the policy statements constituted a governing document that was in breach of public interest governance principles of freedom of speech and academic freedom.<\/p>\n<p class=\"dcr-130mj7b\">But Sussex challenged the OfS ruling on multiple grounds, including that the trans and non-binary equality policy statement at the centre of the OfS case was not a core governing document of the university and so not subject to OfS registration conditions.<\/p>\n<p class=\"dcr-130mj7b\">It also argued that the university\u2019s internal \u201cscheme of delegation\u201d \u2013 the subject of the second breach \u2013 formed part of its internal rules and was also outside OfS jurisdiction.
