{"id":26552,"date":"2025-10-07T20:53:47","date_gmt":"2025-10-07T20:53:47","guid":{"rendered":"https:\/\/naijaglobalnews.org\/?p=26552"},"modified":"2025-10-07T20:53:47","modified_gmt":"2025-10-07T20:53:47","slug":"cps-to-appeal-against-dismissal-of-terrorism-charge-against-kneecaps-liam-og-o-hannaidh-kneecap","status":"publish","type":"post","link":"https:\/\/naijaglobalnews.org\/?p=26552","title":{"rendered":"CPS to appeal against dismissal of terrorism charge against Kneecap\u2019s Liam \u00d3g \u00d3 hAnnaidh | Kneecap"},"content":{"rendered":"<p>\n<\/p>\n<p class=\"dcr-130mj7b\">Prosecutors have said they will appeal against the chief magistrate\u2019s decision to throw out a terrorism charge against the Kneecap rapper Liam \u00d3g \u00d3 hAnnaidh.<\/p>\n<p class=\"dcr-130mj7b\">The 27-year-old, known as Mo Chara, had been charged with a terrorism offence for allegedly displaying a Hezbollah flag at a gig at the O2 Forum in Kentish Town, north London, last November.<\/p>\n<p class=\"dcr-130mj7b\">But last month Paul Goldspring, sitting at Woolwich crown court, agreed with \u00d3 hAnnaidh\u2019s defence team, who had argued there was a legal mistake in the way the charge was brought against him.<\/p>\n<p class=\"dcr-130mj7b\">In a short statement, a Crown Prosecution Service (CPS) spokesperson said: \u201cWe are appealing the decision to dismiss this case as we believe there is an important point of law which needs to be clarified.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Brenda Campbell KC, representing \u00d3 hAnnaidh, argued that the attorney general, Richard Hermer, had not given permission for the case to be brought against the defendant when police informed him he was to face a terrorism charge on 21 May and so it was outside the six-month statutory time limit.<\/p>\n<p class=\"dcr-130mj7b\">The CPS position, which it made at trial, is that the appropriate permission from the attorney general only had to be obtained by the point at which the case proceeded in court, and therefore it was not necessary at the point at which the charge was issued.<\/p>\n<p class=\"dcr-130mj7b\">Goldspring rejected its arguments at trial, saying they \u201cdefy logic\u201d. He ruled that the charge was \u201cnull\u201d and \u201cunlawful\u201d. After the chief magistrate\u2019s decision, \u00d3 hAnnaidh, who was referred to by his anglicised name, Liam O\u2019Hanna, in court documents, told dozens of his supporters who had gathered outside: \u201cThis entire process was never about me. It was never about any threat to the public, it was never about terrorism \u2013 a word used by your government to discredit people you oppress.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt was always about Gaza, about what happens if you dare to speak up.\u201d He accused the British government of attempting to silence the band.<\/p>\n<p class=\"dcr-130mj7b\">Responding to the impending appeal, Kneecap said: \u201cOnce again this is a massive waste of taxpayers\u2019 money, of police time, of court time. Once again there are endless news reports about Mo Chara, about Kneecap but we are NOT the story.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe will fight you in your court again. We will win again.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Goldspring\u2019s decision was welcomed by Northern Ireland\u2019s first minister, Michelle O\u2019Neill, in a post on X. She said: \u201cThese charges were part of a calculated attempt to silence those who stand up and speak out against the Israeli genocide in Gaza.<\/p>\n<p class=\"dcr-130mj7b\">\u201cKneecap have used their platform on stages across the world to expose this genocide, and it is the responsibility of all of us to continue speaking out and standing against injustice in Palestine.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Kneecap were also investigated by police for their 28 June performance at Glastonbury festival, where they led a packed crowd in chants such as \u201cFuck Keir Starmer\u201d.
