{"id":25852,"date":"2025-10-04T13:32:27","date_gmt":"2025-10-04T13:32:27","guid":{"rendered":"https:\/\/naijaglobalnews.org\/?p=25852"},"modified":"2025-10-04T13:32:27","modified_gmt":"2025-10-04T13:32:27","slug":"teslas-insurance-arm-accused-of-egregious-delays-and-systemic-failures-by-ca-regulator","status":"publish","type":"post","link":"https:\/\/naijaglobalnews.org\/?p=25852","title":{"rendered":"Tesla&#8217;s insurance arm accused of &#8216;egregious delays&#8217; and &#8216;systemic failures&#8217; by CA regulator"},"content":{"rendered":"<p>\n<\/p>\n<p id=\"speakable-summary\" class=\"wp-block-paragraph\">Tesla has been hit with an enforcement action by California\u2019s Department of Insurance (CDI) for routinely denying or delaying customer claims despite years of warnings from the state regulator, according to a new pair of filings.<\/p>\n<p class=\"wp-block-paragraph\">Tesla\u2019s insurance arm, along with its partner State National Insurance Company, engaged in \u201cwillful unfair claims settlement practices\u201d including \u201cegregious delays in responding to policyholder claims in all steps\u201d of the process and \u201cunreasonable denials,\u201d CDI wrote. This has allegedly caused \u201cfinancial harm\u201d and \u201cdistress to policyholders.\u201d<\/p>\n<p class=\"wp-block-paragraph\">CDI first approached Tesla about these issues in 2022, according to the filings, yet it claims things have only gotten worse. \u201cIn 2025, the Tesla Companies have already had more complaints, more justified complaints, and committed more violations than in the three previous years combined,\u201d the regulator wrote. <\/p>\n<p class=\"wp-block-paragraph\">Tesla and State National could face penalties up to $5,000 for each \u201cunlawful, unfair, or deceptive act\u201d and up to $10,000 for each \u201cwillful\u201d act, according to the filings. The companies have 15 days to respond. <\/p>\n<p class=\"wp-block-paragraph\">The enforcement action could have knock-on legal effects for Tesla. In July, the company was hit with a proposed class action lawsuit over allegations that the company purposely delayed and minimized claim payouts. CDI wrote Friday that Tesla\u2019s actions may have created \u201cpotential third-party liability exposure.\u201d Tesla and State National did not immediately respond to a request for comment.<\/p>\n<p class=\"wp-block-paragraph\">Tesla launched its in-house insurance product in 2019. The idea was to offer cheaper premiums and faster service. But it got off to a rocky start. The website repeatedly crashed, and when it didn\u2019t, it offered quotes that were far higher than owners expected. Still, Musk promised it would be a \u201crevolutionary\u201d product.<\/p>\n<p class=\"wp-block-paragraph\">Just three years later, according to CDI\u2019s filings, the regulator noticed a \u201cmarked uptick in claims-related consumer complaints\u201d against Tesla. It also accused the companies of not reporting the claims-handling problems.<\/p>\n<p class=\"wp-block-paragraph\">As a result, CDI subjected Tesla and State National to a sort of probationary period: the regulator monitored the companies\u2019 efforts to reduce these violations for six months. Tesla and State National \u201cconceded\u201d that they had underestimated the volume of claims and the staffing required to handle them, according to CDI, and promised to beef up hiring.<\/p>\n<p class=\"wp-block-paragraph\">It took Tesla until April 2023 to hire a new Head of Claims. Through the rest of that year, Tesla and State National \u201creported improvements in the quality\u201d of their claims handling and the \u201cresolution of consumer complaints.\u201d <\/p>\n<p class=\"wp-block-paragraph\">Later that year, Reuters published an investigation into Tesla\u2019s insurance arm that showed things weren\u2019t so rosy. <\/p>\n<p class=\"wp-block-paragraph\">CDI came to the same realization in 2024. The regulator noticed a \u201csignificant increase\u201d in both consumer complaints against Tesla and \u201cviolations of the law,\u201d according to the filings. CDI had received just 83 consumer complaints against Tesla in 2022, but in 2024, that number jumped to 829. In 775 of those cases, CDI found Tesla had violated the state\u2019s insurance code.<\/p>\n<p class=\"wp-block-paragraph\">Things have only gotten worse, according to CDI. Through September 22 of this year, the regulator has received 1,481 complaints against Tesla, and identified 1,969 insurance code violations.<\/p>\n<p class=\"wp-block-paragraph\">In total, since 2022, CDI said Tesla has accumulated nearly 3,000 violations of state insurance law. The majority of those violations involve Tesla failing to respond to customers within the mandatory 15-day period. CDI said it identified 166 violations in which Tesla filed to conduct a \u201cthorough, fair, and objective investigation\u201d into a claim.<\/p>\n<p class=\"wp-block-paragraph\">\u201cCDI repeatedly notified [Tesla] of its claims-mishandling issues and violations of law,\u201d the regulator wrote. \u201cWhile [Tesla] repeatedly committed to improvements, the number of justified complaints and violations continued to mount, demonstrating [Telsa\u2019s] failure to correct its practices.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Tesla has been hit with an enforcement action by California\u2019s Department of Insurance (CDI) for routinely denying or delaying customer claims despite years of warnings from the state regulator, according to a new pair of filings.
