{"id":24188,"date":"2025-09-27T07:34:42","date_gmt":"2025-09-27T07:34:42","guid":{"rendered":"https:\/\/naijaglobalnews.org\/?p=24188"},"modified":"2025-09-27T07:34:42","modified_gmt":"2025-09-27T07:34:42","slug":"terrorism-case-against-kneecap-rapper-liam-og-o-hannaidh-thrown-out-kneecap","status":"publish","type":"post","link":"https:\/\/naijaglobalnews.org\/?p=24188","title":{"rendered":"Terrorism case against Kneecap rapper Liam \u00d3g \u00d3 hAnnaidh thrown out | Kneecap"},"content":{"rendered":"<p>\n<\/p>\n<p class=\"dcr-130mj7b\">A terrorism charge against the Kneecap rapper Liam \u00d3g \u00d3 hAnnaidh has been thrown out by the chief magistrate due to a technical error.<\/p>\n<p class=\"dcr-130mj7b\">\u00d3 hAnnaidh had been charged with a terrorism offence for allegedly displaying a Hezbollah flag at a gig at the O2 Forum in Kentish Town, north London, last November.<\/p>\n<p class=\"dcr-130mj7b\">But sitting at Woolwich crown court, the chief magistrate, Paul Goldspring, agreed with \u00d3 hAnnaidh\u2019s defence team, who had argued there was a legal mistake in the way the charge was brought against him.<\/p>\n<p class=\"dcr-130mj7b\">\u00d3 hAnnaidh told supporters outside the court on Friday: \u201cWe will not be silent.\u201d His defence team, led by Brenda Campbell KC, argued that the attorney general, Richard Hermer, had not given permission for the case to be brought against the defendant when police informed him he was to face a terrorism charge on 21 May.<\/p>\n<p><span class=\"dcr-1inf02i\"><\/span><span class=\"dcr-1qvd3m6\">\u00d3 hAnnaidh speaks to supporters outside Woolwich crown court after the case was thrown out. <\/span> Photograph: Victoria Jones\/Shutterstock<\/p>\n<p class=\"dcr-130mj7b\">Goldspring ruled that the charge against the 27-year-old Belfast musician was \u201cunlawful\u201d and \u201cnull\u201d. Concluding the reasons for his decision, he said: \u201cI find that these proceedings were not instituted in the correct form, lacking the necessary DPP [director of public prosecutions] and AG [attorney general] consent within the six-month statutory time limit set by section 127.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe time limit requires consent to have been granted at the time or before the issue of the requisition. Consequently the charge is unlawful and null and this court has no jurisdiction to try the charge.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Michael Bisgrove, for the prosecution, previously told a court that permission from the director of public prosecutions and attorney general was not required until the defendant\u2019s first court appearance and that permission did not need to be sought in order to bring a criminal charge.<\/p>\n<p class=\"dcr-130mj7b\">The chief magistrate dismissed the arguments, telling the court they \u201cdefy logic\u201d.<\/p>\n<p class=\"dcr-130mj7b\">There were loud cheers from the public gallery as the chief magistrate handed down his judgment. \u00d3 hAnnaidh smiled and gave a thumbs up sign to his supporters.<\/p>\n<p class=\"dcr-130mj7b\">The Crown Prosecution Service said it was \u201creviewing the decision of the court carefully\u201d. It said the decision could be appealed.<\/p>\n<p class=\"dcr-130mj7b\">Dozens of \u00d3 hAnnaidh\u2019s supporters, who had gathered outside the court, cheered as the decision was relayed to the crowd. Some waved Palestine and Irish flags. Others held aloft placards that read Free Mo Chara, referencing the rapper\u2019s stage name.<\/p>\n<p class=\"dcr-130mj7b\">\u00d3 hAnnaidh, who is referred to by his anglicised name Liam O\u2019Hanna in court documents, arrived at court wearing a Palestinian keffiyeh, a balaclava in the colours of the Irish tricolour and sunglasses.<\/p>\n<p class=\"dcr-130mj7b\">After walking out of the court he told supporters: \u201cThis entire process was never about me. It was never about any threat to the public, it was never about terrorism \u2013 a word used by your government to discredit people you oppress.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt was always about Gaza, about what happens if you dare to speak up.\u201d<\/p>\n<p class=\"dcr-130mj7b\">He added: \u201cYour attempts to silence us have failed because we\u2019re right and you\u2019re wrong. We will not be silent. We said we would fight you in your court and we would win. Today, we have. If anyone on this planet is guilty of terrorism, it\u2019s the British state. Free Palestine.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The West Belfast MP Paul Maskey, who attended court on Friday, said the decision not to proceed with the trial was the right one. \u201cKneecap have bravely and unapologetically used their platform around the world to call out Israel\u2019s genocide and the complicity of western governments,\u201d the Sinn F\u00e9in politician said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt is the Israeli war criminals and those who fund, support and enable genocide and forcibly starve women and children who should be before the courts, not Kneecap\u2019s Mo Chara. The British political assault on Kneecap which led to this case has failed. Today, those on the right side of history have prevailed.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Kneecap\u2019s manager, Daniel Lambert, wrote on X: \u201cWe have won!!!!!! Liam Og is a free man. We said we would fight them and win. We did (Twice). Kneecap has NO charges OR convictions in ANY country, EVER. Political policing has failed. Kneecap is on the right side of history. Britain is not. Free Palestine.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Lambert said he was not surprised the case was thrown out and that the group will not change \u201canything they do\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Asked if he has a message for Keir Starmer, O hAnnaidh said: \u201cBetter luck next time.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Northern Ireland\u2019s first minister, Michelle O\u2019Neill, welcomed the decision. In a post on X, she said: \u201cAll charges have been dropped against Kneecap\u2019s Mo Chara. I strongly welcome this decision.
